What Is the Legal Process for a Criminal Case?

Having a knowledgeable criminal defense attorney can make a substantial difference in the outcome of your case. Although every situation is different, most criminal prosecutions in California follow a similar process.

  • Investigation. Law enforcement officers gather evidence and determine whether criminal activity may have occurred.
  • Arrest. Police may arrest a suspect if they believe there is probable cause that a crime was committed.
  • Arraignment. The defendant appears before a judge, hears the charges, and enters a plea.
  • Pretrial Proceedings. Attorneys exchange evidence, file motions, negotiate plea agreements, and prepare for trial.
  • Trial. If a case does not settle, it proceeds to trial, where the prosecution must prove guilt beyond a reasonable doubt.
  • If convicted, the court may impose penalties that include jail or prison, fines, probation, counseling requirements, or other sanctions.

Types of Cases We Handle

Domestic Violence

Domestic violence allegations can arise from disputes involving spouses, dating partners, family members, or household members. Prosecutors aggressively pursue these cases, even when the alleged victim wishes to drop the charges.

A conviction can result in jail time, protective orders, firearm restrictions, and lasting damage to personal and professional relationships. An experienced lawyer can examine witness statements, police reports, and physical evidence to identify weaknesses in the prosecution's case.

Drug Crimes

California drug offenses range from simple possession charges to allegations involving transportation, manufacturing, and possession for sale.

Drug crime convictions may result in incarceration, probation, fines, and other serious penalties. Defense strategies often involve challenging searches, seizures, laboratory testing procedures, and the legality of police conduct.

DUI Cases

Driving under the influence remains one of the most commonly prosecuted offenses in California. DUI charges may involve alcohol, prescription medications, marijuana, or other controlled substances.

Attorney James N. Dicks has completed extensive DUI-related training involving field sobriety testing, breath testing, blood testing, and drug recognition procedures. His experience allows him to challenge unreliable evidence and identify flaws in the prosecution's case.

A DUI conviction can result in serious penalties, including license suspension, jail time, fines, probation, mandatory education programs, and ignition interlock device requirements. The specific consequences depend on factors such as your blood alcohol concentration, prior offenses, and whether the incident involved injuries or property damage.

Sex Crimes

Sex crime allegations include sexual battery, rape, child molestation, possession of unlawful materials, and internet-related offenses. A conviction for any of these offenses can result in severe penalties, including imprisonment, substantial fines, and potential registration requirements under California's sex offender laws.

Sex Offender Registration in California

A conviction for certain sex offenses in California may require registration as a sex offender under California Penal Code § 290, which can have long-lasting effects on a person's reputation, employment opportunities, and housing options. Depending on the offense and tier classification, registration requirements may last for years or, in some cases, for life.

Theft Crimes

Theft offenses range from shoplifting and petty theft to burglary and grand theft charges. Even a seemingly minor theft conviction can create employment difficulties and affect future opportunities. Defense strategies may involve challenging intent, ownership issues, witness identification, or the value of the property involved.

Armed Robbery

Armed robbery is among the most serious theft-related offenses prosecuted in California. These cases typically involve allegations where force or fear was used to take property while a weapon was present.

Convictions can carry lengthy prison sentences and significant sentencing enhancements. An experienced defense lawyer can thoroughly examine identification procedures, witness testimony, surveillance evidence, and forensic evidence.

Assault & Battery

Assault and battery charges frequently arise from fights, disputes, and misunderstandings. Prosecutors may file charges even when injuries are minor or conflicting accounts exist. A careful review of witness statements and physical evidence can be critical to building a strong defense.

Arson

Arson allegations involve accusations that a person intentionally or recklessly set fire to property, structures, or land. These cases often rely heavily on expert testimony, fire investigation reports, and forensic evidence. Defense attorneys may challenge the cause of the fire, investigative conclusions, or the prosecution's theory regarding intent.

Carjacking

Carjacking charges involve allegations that a vehicle was taken through force or fear. These offenses are treated extremely seriously under California law and may result in substantial prison sentences. A defense attorney can examine identification procedures, witness testimony, surveillance footage, and other evidence to determine whether constitutional violations or evidentiary weaknesses exist.

Child Abuse

Child abuse allegations may involve claims of physical abuse, neglect, emotional abuse, or endangerment. These cases often generate strong emotions and can impact both criminal proceedings and family relationships. A thorough investigation is often necessary to evaluate medical records, witness statements, and the circumstances surrounding the allegations.

Murder / Manslaughter

Homicide charges are among the most serious criminal allegations a person can face. Murder and manslaughter cases frequently involve extensive investigations, expert testimony, forensic evidence, and complex legal issues.

Because the stakes are so high, defendants facing homicide charges require experienced and aggressive legal representation from an Escondido violent crime defense lawyer. Defense strategies may include challenging forensic evidence, establishing self-defense, disputing intent, or exposing weaknesses in the prosecution's case.

Reasons to See a Lawyer Right Away

Delaying legal representation can harm your defense and limit available options. Seeking immediate legal counsel can make it easier to:

  • Preserve Evidence. Witness memories fade, surveillance footage can be erased, and physical evidence may disappear. Early intervention allows your lawyer to preserve important evidence.
  • Avoid Costly Mistakes. Statements made to law enforcement can often be used against you. An attorney can help ensure that your rights are protected during questioning.
  • Build a Strong Defense. The earlier a lawyer becomes involved, the more time there is to investigate the allegations and prepare a defense strategy.
  • Begin Negotiating Before Charges Are Filed. In some situations, an attorney can communicate with investigators or prosecutors before charges are formally filed and may be able to influence charging decisions.

Case Results

Felony DUI Causing Injury - Charges Reduced

A very serious case came in with a young woman who was being charged with a felony VC 23153(A)(B)- Driving Under the Influence Causing Injury, Prior DUI within 10 years of VC23152 (A) conviction and VC20001 (A)- Hit and Run with Injury. This was a very serious case, as the initial Preliminary Alcohol Screen Information had her blood alcohol level at a 0.29%. She submitted to a blood test, and it came back as 0.27%, and she was facing a maximum of three years in prison. After several meetings with the district attorney and the judge, Attorney James N. Dicks was able to have it reduced to a misdemeanor under VC 23153 (A), with VC 23540 (a prior) and VC 23578. She had to enroll in the multiple conviction programs and, in lieu of jail time, she was ordered to do the SCRAM program for thirty (30) days.

Unlawful Possession of a Controlled Substance - Charges Dropped

Attorney Dicks takes a very aggressive stance in investigating cases before charges have been filed. In many cases, it is possible to speak with the investigators before they recommend to the District Attorney's office that formal charges be filed. In one instance, we had a young man charged with HS 11350(A)-Unlawful Possession of a Controlled Substance. Before going to his arraignment, Attorney Dicks talked to the detective and presented evidence that the client was lawfully entitled to have the controlled substance. The case was completely dropped, and the client was extremely happy not to have this on his record.
