YOUR FREEDOM. YOUR FUTURE.
San Diego Expungement Attorney
A past conviction can continue to affect your work and opportunities. California offers different forms of record relief. We can help you understand which may apply—and what they do and do not change.

What does expungement mean in California?
The term “expungement” often refers to a dismissal under Penal Code section 1203.4 or a related statute. In a qualifying case, the court may allow withdrawal of a guilty or no-contest plea, or set aside a guilty verdict, and dismiss the accusation. This is not the same as erasing every record or declaring factual innocence.
Dismissal, arrest-record sealing, and automatic record relief are different remedies. The appropriate process depends on whether the matter ended in a conviction, the sentence, completion of probation, and the statute involved.
Reviewing your eligibility
Eligibility is individualized. Counsel reviews the conviction, sentence, probation history, current proceedings, and any statutory exclusions. Some relief is mandatory when conditions are met; other requests are discretionary. Other statutes may provide relief for certain people who served prison terms, so a blanket rule that all prison cases are ineligible is not accurate.
- Obtain the court record and confirm the exact conviction and sentence.
- Determine the correct petition, court, notice, and supporting documents.
- Explain rehabilitation and circumstances supporting discretionary relief where relevant.
Important limits: dismissal is not erasure
A dismissed conviction may remain visible in court records and may still count as a prior offense in later proceedings. Dismissal does not ordinarily restore firearm rights or eliminate immigration consequences. Certain government, licensing, and other applications still require disclosure.
Employment disclosure rules and background-check obligations depend on the application and applicable law. Seek advice before answering a question about your record rather than assuming you can always say that you were never convicted.
