YOUR FREEDOM. YOUR FUTURE.
San Diego DMV Hearing & License Suspension Attorney
Your driving privilege can be at risk before your criminal case is resolved. A prompt hearing request and a focused review of the evidence can help protect your options.

The 10-day deadline matters
After an alcohol-related DUI arrest, a driver commonly receives a notice of administrative suspension and a temporary license. You generally have 10 days from receipt of the notice to request a DMV hearing. Read the actual notice and contact counsel immediately rather than waiting for your court date.
A hearing request can preserve the opportunity to challenge the administrative action. Ask about a stay of suspension while the matter is pending; a request alone is not a guarantee that every restriction is postponed.
The DMV case is separate from the criminal case
The DMV decides administrative driving-privilege issues. A criminal court decides criminal charges and can impose separate consequences. A favorable result in one process does not automatically eliminate every consequence in the other; the effect depends on the specific findings and applicable law.
Depending on the notice, the hearing may address reasonable cause, the lawfulness of the arrest, the alcohol result, or an alleged refusal and the warnings given. Counsel can request records, review reports, present evidence, and question witnesses when appropriate.
Building the administrative defense
The defense may examine the stop, identification of the driver, timing and reliability of testing, and whether the officer properly explained refusal consequences. Device problems or a medical inability to complete testing should be evaluated rather than assumed to be a refusal.
DMV also handles matters involving negligent-operator points, medical conditions, and other driving issues. The hearing type, notice, and deadlines differ. Bring every DMV letter and your temporary license to your consultation.
Restricted licenses and ignition interlock options
Eligibility for a restricted license or ignition interlock device option depends on the offense, prior history, refusal findings, program enrollment, insurance proof, and current DMV requirements. There is no single waiting period or restriction that applies to every case.
Do not drive based on an assumption that you qualify. Confirm your current status and authorization with the DMV and discuss the conditions with your lawyer. jD LAW can evaluate your criminal defense and DMV hearing together.
