YOUR FREEDOM. YOUR FUTURE.
San Diego BAC & Chemical Testing Defense
A breath or blood result is evidence—not the end of your defense. How a sample was collected, handled, and analyzed can be just as important as the number on the report.

What BAC results can and cannot establish
California generally prohibits driving with a blood alcohol concentration of 0.08% or more for drivers age 21 and older. Different limits apply to commercial driving and certain other circumstances. Drivers under 21 can face administrative consequences at 0.01%. A person may also be charged with impaired driving below 0.08% if the evidence supports it.
The prosecution must connect its evidence to the time of driving. Drinking history, test timing, alcohol absorption, and other facts may matter. Neither a high result nor a procedural concern automatically decides the case.
Examining breath testing
Breath instruments measure alcohol in exhaled breath. Counsel can review maintenance, calibration, operator training, observation procedures, the sequence of samples, and possible mouth-alcohol contamination. Medical conditions and testing circumstances may require expert evaluation.
A preliminary roadside breath test and an evidentiary chemical test after arrest are not necessarily governed by the same rules. Refusal obligations depend on age, DUI probation, arrest status, and the particular request.
Examining blood evidence
Blood testing requires attention to lawful collection, sample preservation, chain of custody, laboratory procedures, and interpretation. An attorney may examine the legal basis for the blood draw and whether independent testing of a retained sample would assist the defense.
A warrant, valid consent, or a legally recognized exception may be relevant to a blood draw. Not every testing error leads to suppression; the remedy depends on the legal violation and the evidence.
Refusal allegations and your license
California’s implied-consent law can impose serious consequences for refusing a required chemical test after a lawful DUI arrest. Counsel should review the warning, what was requested, any physical inability to complete testing, and whether the record supports a refusal.
DMV and criminal proceedings are separate. If you receive an administrative suspension notice, act immediately: the usual deadline to request a DMV hearing is 10 days after receiving notice. Contact jD LAW to review both tracks.
