YOUR FREEDOM. YOUR FUTURE.
San Diego State Crime Defense Lawyer
A California criminal accusation deserves an individual defense, not assumptions about guilt. Understand the charges, protect your constitutional rights, and prepare for the next step in court.

California offenses and due process
State offenses arise under California law, including the Penal Code, Vehicle Code, Health and Safety Code, and other statutes. They range from infractions and misdemeanors to serious felonies. The charging document and specific statute identify the elements, potential punishment, and procedural rules that apply.
Due process includes a fair opportunity to understand and contest the allegations. At trial, the prosecution must prove the required elements beyond a reasonable doubt. Arrest, a police report, or an accusation is not a determination of guilt.
State versus federal criminal proceedings
State cases are prosecuted by authorized local or state prosecutors in California courts. Federal cases are prosecuted by the U.S. Attorney’s Office under federal law. Police and investigative agencies gather evidence; they are not the same as the prosecuting office. Some incidents can raise questions in both systems.
Rules governing discovery, hearings, release, and sentencing differ. Your lawyer should determine the actual jurisdiction and assess any overlap rather than assume that crossing a border or involvement of an agency automatically resolves the issue.
From the alleged offense to a defense
Theft cases may turn on ownership, intent, and value. Drug cases can involve possession, sales evidence, and search procedures. Assault or homicide cases may raise identification, causation, or self-defense questions. A strategy must fit the actual charge and evidence rather than a general category.
Counsel can investigate, review discovery, challenge unlawful evidence, represent you at hearings, and evaluate negotiations or trial. Diversion, reduced charges, or mitigation may be available in some cases. No attorney can promise dismissal or a particular sentence.
