YOUR FREEDOM. YOUR FUTURE.
San Diego Pre-File Investigation Lawyer
You do not have to wait for an arrest or court date to protect your rights. Early legal advice can help preserve evidence and guide your response while investigators and prosecutors evaluate an allegation.

What is a pre-file investigation?
Pre-file describes the period before charges are formally filed. Police may interview witnesses, review messages and video, seek laboratory results, or submit a report for prosecutor review. The prosecutor can file charges, reject a referral, or request more investigation. There may be no case number even though the matter is serious.
Warning signs include a detective’s call, contact with family or coworkers, a search warrant, seized property, or a request for documents. An online court search that shows no case does not prove that an investigation has ended.
What early defense work can do
Counsel may identify the investigating agency, preserve recordings before they are overwritten, locate witnesses, assess an interview request, and gather exculpatory evidence. Appropriate mitigation or missing context may be presented strategically to investigators or prosecutors. Whether to disclose defense information is an individual decision, not an automatic step.
Early work sometimes contributes to a decision not to file, but no lawyer controls or can guarantee the charging decision. Hiring counsel does not itself mean charges will follow. It gives you advice while the evidence and allegations are still developing.
Protect evidence without creating new problems
Keep messages, photographs, receipts, location records, calendars, and witness details in their original form. Write down relevant dates for counsel. Do not delete, hide, alter, or manufacture evidence. Avoid approaching the reporting person or witnesses to seek a retraction, and do not discuss the allegations publicly.
Before giving investigators “your side,” obtain advice. Remain polite and do not lie. Subpoenas and other compulsory requests need prompt legal review, not silence or disregard. Investigation length and filing deadlines vary by offense; weeks without contact do not necessarily close the matter.
