How Much Marijuana Can One Possess Legally in CA?

While California was the first to make medicinal marijuana legal back in 1996, it was the fifth state in the country to legalize recreational pot. Now, those who just want to smoke every now and then can, as they might have a glass of wine. But when the vote came in on Proposition 64 in November 2016, there were still some questions left.

One of those was how much marijuana a person can legally possess in California.

How Much?

The amount that can be carried in California depends on the type of marijuana.

  • People over the age of 21 may carry and consume up to 1 ounce of marijuana flowers, or the bud that is smoked; and only 8 grams of concentrates. Concentrates include the oil that is often placed into vape pens, wax, shatter, or other concentrate that is not the actual flowers.

This works out to approximately 57 joints containing half a gram of flowers, 16 cartridges for vape pens, and 40 brownies or 80 packs of gummy bears. Of course, the amounts contained within different edibles will vary, so it is important for everyone to check these amounts before carrying or consuming.

But there are other laws to keep in mind, as well.

Just Remember These Laws

Currently, individuals are not allowed to walk around in public while consuming. This is similar to California’s current alcohol laws that prohibit open containers in public. Consuming marijuana can only be done on private property (which many activists in the state are trying to fight).

It is also still very illegal to carry or consume marijuana while driving. This crime falls under California’s driving under the influence laws and it is one that is taken very seriously. If anyone is caught driving under the influence of marijuana, it could result in fines, jail time, and most likely a suspension of his/her license.
